I'm also not getting this E.A. only link, as it was Fish Legal who challenged NRW a couple of years back re phosphate pollution on the Wye, as a result of the spreading of poultry muck as fertiliser in Powys. You may recall that NRW came back quoting data from 2009 and 2015, stating there was no issue and when asked where the data was for the last 7 years, they didn't have any. It was a complete joke!

Government in court over chicken poo in River Wye

Campaign group River Action say the Environment Agency did not enforce rules to stop fertilisers and chicken manure getting in river.

I did find this contained statement from the E.A. to be laughable:

The Environment Agency said it does not comment on ongoing legal proceedings but that "anyone caught breaching environmental laws faces enforcement action, up to and including prosecution".

Last year where over a 100 cases were recommended for prosecution, they proceeded with less than 10 cases. They Wye catchment isn't the only thing, which is full of sh*t!

We wanted to update you on a key piece of work in our mission. We have gathered evidence and believe the Environment Agency has repeatedly failed to enforce existing regulations to protect the River Wye. This week we have been in court to prove it.

On Wednesday 7th Feb, we presented our case against the Environment Agency and DEFRA. Watch this short video to see the amazing turnout from our friends in the Wye Valley, and beyond, who came out to support us.
Today the court are hearing the Environment Agency and DEFRA's defence, and then it'll be an agonising wait to hear the result.

The River Wye was our first catchment specific campaign, and we’ve been working with communities and activists along it since River Action started.
“We’re fed up of begging the Environment Agency to enforce the law against farming pollution. We’re so grateful to River Action for bringing this legal challenge, which we consider crucial in the fight to protect and restore the River Wye.” Tom Tibbits, Chair of Friends of the Upper Wye.
We’ve done very well to get this far - many cases are thrown out before this stage, and even we had to appeal the first time around. Now, the judge believes the evidence we have needs to be heard in court.
